1. Identity and scope
ATC Cruises, established at Mechelsesteenweg 62, 2018 Antwerp, VAT BE 0123.456.789, licensed travel agency (licence number TO 0000), hereinafter referred to as "ATC Cruises" or "the agency".
These general terms and conditions apply to all quotations, agreements and services provided by ATC Cruises, unless explicitly agreed otherwise in writing. By placing a booking, the client accepts these terms.
2. Formation of the agreement
A travel agreement is concluded once ATC Cruises has confirmed the booking in writing (by email or letter) and the client has paid the requested deposit. The confirmation states the essential elements of the trip: destination, dates, ship, accommodation and price.
Quotations are non-binding and valid for 5 working days unless otherwise stated. Prices and availability are subject to change by the cruise line until confirmation.
3. Pricing and payment
All prices are in euros per person and include the services listed. Unless otherwise agreed, the following payment schedule applies:
- Deposit: 20% of the total price upon booking (min. €200 per person)
- Balance: to be paid in full at least 60 days before departure
- For bookings within 60 days of departure: full payment at time of booking
In the event of late payment, ATC Cruises reserves the right to cancel the booking and charge cancellation fees.
4. Price changes
ATC Cruises reserves the right to adjust the agreed price up to 20 days before departure if costs increase due to: fuel surcharges by the cruise line, exchange rate fluctuations exceeding 2%, or new taxes and levies imposed by government authorities.
5. Cancellation by the client
In the event of cancellation by the client, the following costs apply, calculated on the total trip cost:
- More than 90 days before departure: loss of deposit
- Between 90 and 60 days: 25% of the trip cost
- Between 60 and 30 days: 50% of the trip cost
- Between 30 and 14 days: 75% of the trip cost
- Less than 14 days before departure: 100% of the trip cost
6. Cancellation or modification by ATC Cruises
ATC Cruises reserves the right to cancel or modify a trip due to force majeure (such as war, natural disasters, epidemics) or insufficient participants. In the event of cancellation by the agency, the client is entitled to a full refund or an equivalent alternative.
If the cruise line cancels the trip or significantly changes the routing, any compensation offered by the cruise line will be passed on to the client.
7. Travel documents and client responsibilities
The client is solely responsible for having valid travel documents (passport, visa, vaccination certificate). ATC Cruises provides advice but accepts no liability for refusal by border authorities or cruise lines.
The client must notify ATC Cruises of any medical conditions, allergies or special needs before booking. ATC Cruises will inform the cruise line but cannot provide guarantees.
8. Liability
The liability of ATC Cruises as an intermediary is limited to the services provided directly by the agency. For services rendered by cruise lines, hotels or other third parties, we refer to their own terms and conditions.
ATC Cruises is not liable for damages resulting from force majeure, actions of third parties, or circumstances beyond the reasonable control of the agency. Liability is in any case limited to twice the total trip cost.
9. Complaints
Complaints during the trip must be reported immediately on-site to the cruise line representative, to allow for rectification. ATC Cruises must also be notified as soon as possible.
Post-trip complaints must be submitted in writing to ATC Cruises within 30 days via info@atccruises.be. Complaints received after this period will not be processed.
10. Insurance
ATC Cruises holds mandatory insolvency insurance and professional liability insurance in accordance with Belgian legislation on travel agencies.
11. Personal data
The processing of personal data is carried out in accordance with our privacy policy, available on this website. By placing a booking, the client consents to the processing of their personal data for the execution of the travel agreement.
12. Applicable law and disputes
All agreements with ATC Cruises are governed by Belgian law. Disputes are preferably resolved amicably. If no amicable settlement is possible, only the courts of the district of Antwerp have jurisdiction.
Consumers may also use the Online Dispute Resolution platform of the European Commission: ec.europa.eu/consumers/odr.
13. Changes to the terms
ATC Cruises reserves the right to amend these general terms and conditions. The version in force at the time of booking applies to the relevant agreement.
